Privacy Policy

We at Zymplify Limited ("Zymplify" or "we" or "us" or "our") know that your privacy is important. This privacy policy ("Policy") is designed to assist you in understanding how we will collect and use the information you provide when you use (i) our publicly available websites (the "Sites") and (ii) the Zymplify marketing automation platform ( “platform”) and other related services on which we post a direct link to this privacy policy.

This Policy does not cover any other data collection or processing, including without limitation the data we host for our registered customers via the Zymplify platform. If you use our Platform, the data that you (and your customers) submit as you use our Platform will be governed by the applicable Zymplify data processing agreement, and as required by law. For the purposes of our Policy, when we refer to "you" or to a "customer" we mean any past, current or prospective customer of Zymplify, including any visitor to one of our sites.

1. What types of data does Zymplify collect about its users?

Personally identifiable information, which could include your name, street address, telephone number, email address, job title, date and place of birth. If you submit to us any personally identifiable information in relation to another individual, you therefore represent that you have the authority to do so and permit us to use the information in accordance with this policy.

Other information we collect about you that by itself is not personally identifiable information but if combined with personally identifiable information could be used to personally identify you.

IP Address: Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP Address may be identified and logged automatically in our server log files whenever you access the Sites, along with the time of the visit and the page(s) that you visited. Collecting IP Addresses is standard practice and is done automatically by many websites, applications and other services. Zymplify uses IP Addresses to calculate usage levels of the Sites, help diagnose problems with its servers, administer the Sites, and monitoring the regions from which you navigate to Zymplify’s Sites.

2. How does Zymplify collect personal data?

Personal information: We and our service providers may collect personal information in a variety of ways, including:

Through the Sites: We may collect Personal Information through the Sites, e.g., when you request a free trial or demo, register for a webinar, contact us, subscribe to our email newsletter, download content (e.g. whitepapers), or register to use our Sites.

Offline: We may collect Personal Information from you offline, such as when you attend one of our events, during phone calls with sales representatives, or when you contact customer service.

Through You: Zymplify may collect information such as your location or your preferred means of communication when you voluntarily provide it. Unless combined with Personal Information, this information does not personally identify you or any other user of the Sites. Note that there is no legal obligation for you to provide us with Personal Information and any information collected by us will be provided by you at your own will and with your consent.

Information From Other Sources: In order to enhance our ability to provide relevant marketing, offers, and services to you, we may obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms, as well as from other third parties.

Testimonials: We post customer testimonials on our website which may contain personally identifiable data such as the customer’s name. If you no longer wish to have your information displayed on our site please contact dpo@zymplify.com.

Other Information: We and our service providers may collect Other information in a variety of ways such as:
Through Your Browser or Device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, and the name and version of the Sites you are using.

Through Cookies and Other Similar Technologies: Cookies and other similar technologies may be used to collect Other Information. We may use third parties to serve advertisements on other websites that may be of interest to you, based on information collected about your use of our Sites and other websites.  To do so, these companies may place or recognize a unique cookie on your browser (including through the use of pixel tags and web beacons).  Please review our Cookie Policy for more information. Zymplify also uses web analytics services, which currently includes Google Analytics.

Google Analytics is a web analytics service provided by Google Inc. ("Google"). Google Analytics uses cookies and similar technologies to analyse how users use the Domains. The information generated about Domain usage (including your shortened IP address) is transmitted to Google in the U.S. This information is used to evaluate visitors’ use of the Domain, compile statistical reports on Domain activity, and provide other services related to the Site and Internet use. Google may also collect information about Domain visitors’ use of other websites. 3. How does Zymplify use personal data:

4. How will Zymplify share personal data it receives?

Third Party Business Partners:

We may disclose information collected from a customer to our independent contractors and business partners who have agreed to (i) hold this information in confidence, and (ii) not use it for any purpose except to carry out the services they are providing for us.

Such contractors and business partners include those hosting our Services or other data; managing the functionality of our Services; processing credit or other payment card payments; assisting with marketing and promotions; and enabling us to send you email.

To comply with laws and regulations:

We may release Personal Information when we believe that release is necessary or appropriate (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce or apply our conditions of use and other agreements; (e) to protect our operations or those of any of our Affiliates; (f) to allow us to pursue available remedies or limit the damages that we may sustain; and (g) to protect the rights, privacy, property, or safety of Zymplify, our employees, our Affiliates, our users, or any other person or entity.

International Transfers of Data:

We are committed to the security of your personal data and we will not transfer data outside of the EU unless adequate safeguards are in place to ensure that your rights are protected.

We use Full Contact Inc. to acquire social profile handles linked to your email address so that we can provide you with information about our products that you have shown an interest in.

We use SendGrid Inc to send email communications in relation to our products and services and to respond to customer support requests.

5. How can I access, correct, amend or remove information about me?

If you would like to access, correct, amend, remove or limit the use or disclosure of any Personal Information about you that has been collected and stored by Zymplify, please notify us at dpo@zymplify.com so we can consider and respond to your request in accordance with applicable laws.

For your protection, we may only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will respond to your request within 1 month.

6. For how long will Zymplify retain my personal data?

We will retain your Personal Information for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required by law.

7. How can I opt out? 

You may opt out of having your personally identifiable information shared with third parties. To do this, you may contact our Data Protection Officer using the information in the "Contact Us" section of this Policy.

You may opt out of receiving future promotional/marketing messages from us by clicking the "Unsubscribe" link found in the footer of our email messages or by replying STOP to any SMS communications we may send to you.

Please note that if you opt out of promotional/marketing messages, you may continue to receive certain communications from us, such as administrative and services announcements and/or messages about your account/profile.

You may opt out of receiving cookies by updating your preferences on our Cookie Policy.
